Mediation is a faster, more efficient way of resolving disagreements between divorcing spouses, parents or ex-spouses rather than the costly and often slow process of court hearings or trial. With mediation, each party negotiates directly or indirectly with the assistance of a professional mediator. The mediator's role is to help the parties reach an agreement that is fair and definitive, so that the parties will never need court intervention. Most cases that are mediated are resolved entirely within a few months, with only a fraction of the expense and time of court proceedings.
Mediation begins with an exchange of facts and issues between the parties, using the mediator as an impartial facilitator. In some cases, the parties agree that the mediator will be helpful in making some or all decisions for them, if they are unable to do so themselves. Mediation is a creative, interactive process that can be customized to meet the parties' specific needs and timing and cost considerations. In most cases, mediation is successful in resolving the issues entirely within a few months, in contrast to the average 18 months of a contested court trial.
At FasTrack Mediation®, our mediators are experienced attorneys who have collectively resolved thousands of cases through mediation, private judging and court trials. Our decades of experience gives us the insights to help you resolve your case quickly and fairly, without the delays of court procedures and hearings.
At FasTrack Mediation®, we offer classic mediation, which is also known as facilitative mediation. In this process, the mediator works with the parties to help them negotiate directly, or indirectly through the mediator. The mediator uses communications techniques and helps each party consider the disputed issues and to reach a negotiated resolution.
We also offer expedited classic mediation, as a fast-track alternative to traditional mediation. In this approach, the mediator helps the parties set initial deadlines and methods for getting the case resolved quickly. This often involves front-loading a lynchpin issue whose resolution will help other issues be successfully negotiated as well.
At FasTrack Mediation®, we provide evaluative mediation services for those cases that warrant a more hands-on approach from the mediator. Under this plan, the mediator helps the parties settle their case by becoming even more familiar with the issues and facts, so that the mediator is able to express opinions and assessments on how the case would be decided in court.
Binding mediation is used when the parties have a difficult history or a demonstrated lack of trust. Under this method, the parties exchange information and negotiate toward a resolution. However, if the parties are unable to reach a full and final agreement, the mediator will make a decision for them. This process requires more time and attention by the mediator, so that any decision will be fully based on the relevant issues and facts. It can often be particularly beneficial in helping the parties reach a settlement, as the mediator has the authority to guide them to a reasonable solution.
Collaborative law is ideal for divorcing spouses who have both substantial assets and at least a somewhat working relationship allowing them to work together toward a resolution. Under this approach, each spouse retains an attorney, who in turn often retain one or more joint expert consultants, such as an accountant or business appraiser. The spouses and their attorneys work together through a structured, fast-paced approach to develop the facts and issues sufficiently to be resolved in a comprehensive agreement. This is a popular method for complex, high-asset cases that might otherwise require many months or years of court activity.
We offer same-day consultation, which now includes video consultation with a family law professional. At FasTrack Mediation®, we have decades of experience in helping parties resolve their cases through mediation or other forms of alternative dispute resolution. Child custody issues are particularly well-suited for mediation. Parents should always cooperate and work toward agreements over parenting schedules, holidays, vacations, schooling decisions and health care to the greatest extent possible. As a cooperative process directed at encouraging candid dialogue, mediation is ideal for parents who want only the best for their children, without the costs and delays of court.
FasTrack Mediation® provides fast and effective mediation for the full range of divorce issues. Most divorce cases in which mediation is used will be resolved within 2-3 months after the first mediation session. Divorce can be complicated, and the average case handled through court takes 18 months and costs over $15,000 in attorneys fees per spouse. Let us help you resolve your case quickly.
At FasTrack Mediation®, we understand that disputes over child support or spousal support often become more expensive and time-consuming the disputed issues themselves. We have designed innovative mediation processes directed at resolving these issues cooperatively and without the costs and burdens of court hearings. Get your support issues resolved quickly, and stop wasting time with court litigation.
When spouses divorce, one of the most complicated issues involves deciding which property is community and which is separate. Even when separate property has been identified, the spouse who owns it must often prove through "tracing" that it has existed continuously without interruption or "commingling" with community assets. In court, this is an expensive and time-consuming process. Mediation offers a better alternative than court proceedings for spouses who want their cases decided quickly and without the expense and time of court hearings or trial.
When a marital asset consists of a business that is either partly or entirely community property (i.e., acquired during marriage), the parties must negotiate a buy-out price unless they intend to continue owning the asset jointly. The business appraisal process can be complicated and take many months while overseen by an accountant. Mediation provides a superior means of resolving business valuation issues, as an accountant can be retained to assist the parties without the time and cost of a full-blown business appraisal.
It has become increasingly common for ex-spouses to bring each other back to court months or years after a divorce judgment has been made. Even if the parties had not used mediation earlier in their case, it is important to consider doing so for disagreements over modification of orders. This includes common agreements over custody, support, property and retirement accounts. Mediation presents a faster and more efficient method for resolving post-judgment disputes and making it less likely that the ex-spouses will ever have to go back to court again.
