What Is Mediation?

Mediation is a faster, more efficient way of resolving disagreements between divorcing spouses, parents or ex-spouses rather than the costly and often slow process of court hearings or trial. With mediation, each party negotiates directly or indirectly with the assistance of a professional mediator. The mediator's role is to help the parties reach an agreement that is fair and definitive, so that the parties will never need court intervention. Most cases that are mediated are resolved entirely within a few months, with only a fraction of the expense and time of court proceedings.

How Does Mediation Work?

Mediation begins with an exchange of facts and issues between the parties, using the mediator as an impartial facilitator. In some cases, the parties agree that the mediator will be helpful in making some or all decisions for them, if they are unable to do so themselves. Mediation is a creative, interactive process that can be customized to meet the parties' specific needs and timing and cost considerations. In most cases, mediation is successful in resolving the issues entirely within a few months, in contrast to the average 18 months of a contested court trial.

When spouses divorce, one of the most complicated issues involves deciding which property is community and which is separate. Even when separate property has been identified, the spouse who owns it must often prove through "tracing" that it has existed continuously without interruption or "commingling" with community assets. In court, this is an expensive and time-consuming process. When a marital asset consists of a business that is either partly or entirely community property (i.e., acquired during marriage), the parties must negotiate a buy-out price unless they intend to continue owning the asset jointly. The business appraisal process can be complicated and take many months while overseen by an accountant. Mediation provides a superior means of resolving business valuation issues, as an accountant can be retained to assist the parties without the time and cost of a full-blown business appraisal.

It has become increasingly common for ex-spouses to bring each other back to court months or years after a divorce judgment has been made. Even if the parties had not used mediation earlier in their case, it is important to consider doing so for disagreements over modification of orders. This includes common agreements over custody, support, property and retirement accounts.
