Mediation is a faster, more efficient way of resolving disagreements between divorcing spouses, parents or ex-spouses rather than the costly and often slow process of court hearings or trial. Binding mediation is used when the parties have a difficult history or a demonstrated lack of trust. Under this method, the parties exchange information and negotiate toward a resolution. However, if the parties are unable to reach a full and final agreement, the mediator will make a decision for them. This process requires more time and attention by the mediator, so that any decision will be fully based on the relevant issues and facts. It can often be particularly beneficial in helping the parties reach a settlement, as the mediator has the authority to guide them to a reasonable solution.
Collaborative law is ideal for divorcing spouses who have both substantial assets and at least a somewhat working relationship allowing them to work together toward a resolution. Under this approach, each spouse retains an attorney, who in turn often retain one or more joint expert consultants, such as an accountant or business appraiser. The spouses and their attorneys work together through a structured, fast-paced approach to develop the facts and issues sufficiently to be resolved in a comprehensive agreement. When spouses divorce, one of the most complicated issues involves deciding which property is community and which is separate. Even when separate property has been identified, the spouse who owns it must often prove through "tracing" that it has existed continuously without interruption or "commingling" with community assets. In court, this is an expensive and time-consuming process. Mediation offers a better alternative than court proceedings for spouses who want their cases decided quickly and without the expense and time of court hearings or trial.
When a marital asset consists of a business that is either partly or entirely community property (i.e., acquired during marriage), the parties must negotiate a buy-out price unless they intend to continue owning the asset jointly.
